SÍNTESIS:
Analizaremos varias sentencias recientes del Tribunal de la Rota de la Nunciatura Apostólica de España, relativas a los capítulos de grave defecto de discreción de juicio y de incapacidad para asumir las obligaciones esenciales del matrimonio canónico. También, como novedades procesales se comenta una de las comunicaciones de las «Jornadas XXXIV de Actualidad Canónica de la Asociación Española de Canonistas» titulada «Nuevas facultades de la Rota Romana sobre las nulidades matrimoniales». Por último, se hace referencia a una sentencia del reciente Tribunal Eclesiástico de Sant Feliu de Llobregat.
ABSTRACT:
We will discuss several recent judgments of the Rota Tribunale of the Apostolic Nunciature in Spain, regarding the chapters of serious defect of discretion of judgment and disability to assume the essential obligations of canonical marriage. Moreover, we will comment a novelty in the procedural area, which was discussed at the «XXXIV Conference of canon law actuality at the Spanish Association of canonical lawyers» entitled «New powers of the Roman Rota Tribunale on marriage annulments». Finally, referring to a recent judgment by the Ecclesiastical Court of Sant Feliu de Llobregat.
